<div>For estates of individuals dying in 2011/2012, the Federal State tax kicks in above $5 million with a maximum estate tax rate of 35 percent;</div>

A will is generally the written format of the deceased’s last wishes for distribution of their estate. However, a will may be contested for reasons including but not limited to the mental state of the deceased at the time of signing, a question of the legitimacy of the will or the signature. Probate litigation or the contesting of a will or related document is the process of determining the legal heirs or beneficiaries.
